Summit Angler – Terms of Service
1. Acceptance of Terms
By accessing or using the proangler.shop website, you agree to be bound by these Terms of Service. If you do not agree, do not use our services. We may update these terms at any time, and continued use constitutes acceptance of changes.
2. Account Registration
You may create an account to streamline purchases and order tracking. You are responsible for keeping your login credentials confidential. You must be at least 18 years old to register. We reserve the right to suspend or terminate accounts for misuse.
3. Payments and Transaction Processing
All payments are processed by a third-party service provider compliant with PCI-DSS standards. Summit Angler does not collect, store, or access full payment card details. Any payment disputes must be resolved through the payment provider’s own dispute resolution procedures. The available payment methods may change without prior notice.
4. Shipping and Returns
Shipping details are outlined in our Shipping and Returns Policy. For orders shipped to the US, Summit Angler offers a 35-day return window from delivery, which exceeds the standard 14-day withdrawal period required by EU law. This is a commercial commitment, not a legal guarantee. No restocking fees apply. Items must be unused and in original packaging. We will issue a refund within 14 business days of receipt. For EU customers, the 2-year Legal Guarantee of Conformity applies by default; we honor all applicable consumer protections.
5. Intellectual Property
All content on proangler.shop, including text, images, logos, and product descriptions, is owned by Summit Angler or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent. All trademarks and trade names are protected under applicable intellectual property laws.
6. Disclaimer of Warranties
All products and services are provided on an "AS IS" and "AS AVAILABLE" basis. Summit Angler makes no express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. This disclaimer applies to the maximum extent permitted by law. We do not guarantee that the website will be error-free or uninterrupted.
7. Limitation of Liability
In no event shall Summit Angler be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, arising from your use of the site or products. Our total liability for any claim shall not exceed the amount paid by you for the product in question. This limitation applies even if we have been advised of the possibility of such damages.
8. Mandatory Arbitration and Class Action Waiver
Any dispute relating to these Terms or your use of the site shall be resolved exclusively by binding arbitration in Portland, Oregon, before a single arbitrator. The arbitration will be conducted under the rules of the American Arbitration Association. You waive any right to participate in a class action or multi-plaintiff proceeding. By agreeing to these terms, you and Summit Angler each give up the right to a jury trial.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Oregon, USA, without regard to its conflict of law principles. For all purposes, the exclusive venue for any permitted legal action shall be the state or federal courts located in Multnomah County, Oregon. This provision does not limit any mandatory consumer protections under EU law for residents of France, Italy, Poland, Germany, or Spain.
10. EU Consumer Rights
If you are a consumer located in the European Union (France, Italy, Poland, Germany, Spain), you have the right to withdraw from any purchase within 14 days without any reason, as per EU law. Summit Angler extends this to 35 days for all customers, including those in the EU. You also have a 2-year legal guarantee of conformity from the date of delivery. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud. Disputes may be referred to the European Commission’s Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.
